More on Supervision, punishment, and the right to claim for damages.

The National Board of Health and Welfare supervises the observance of the Biobanks Act and can therefore demand that biobanks administrators submit to them whatever documents, samples, and other forms of information it asks for. The National Board of Health and Welfare must also be granted access to the biobank facilities. Refusal to oblige is punishable by a fine.

If biobank regulations are violated, for instance through negligence on the part of a hospital to report the establishment of a biobank, or refusal to destroy or remove identifying labels from samples on withdrawal of consent, then those responsible may be punished by a fine. Both intended and unintended violations are subject to punishment by fine.
Sample providers who, due to improper or damaging handling of biobank material, suffer financial or psychological damage are entitled to claim those responsible for damages.
